Job Description

Department & how it relates to the role

Group Tax has various roles within Network Rail. We

* manage the relationship with HM Revenue and Customs (HMRC)
* influence changes in proposed legislation by representing the Group directly with UK Treasury, other Government Departments or through industry Groups such as the CBI, UK Utilities Group and the Previously Nationalised Industry Group
* provide tax advice and HMRC liaison on specific situations, processes transactions and policy
* identify, evaluate and implement tax savings
* monitor and manage Network Rail compliance with all relevant tax laws (including paying the right amount of tax at the right time, filing returns and keeping up to date with budget changes) and
* calculate the tax numbers which are included in the accounts and in forecasts.

This means that we work closely with a range of areas within the business, but most commonly we speak to people with VAT, SDLT, chargeable gains and employment tax issues.

Our large property and asset portfolio means we have a large number of transactions requiring specialist tax support, as well as a significant volume of reporting which must be undertaken each year.

The Tax Specialist will provide support to Network Rail and its subsidiaries to interpret relevant tax legislation and comply with all legal requirements concerning all taxes, will support negotiation with HMRC and represent Group Tax internally and with HMRC as appropriate.

About the role (External)

The Tax Specialist will potentially have all of the following responsibilities (but this list is not restrictive):

• Manage specific issues and projects or elements of the company’s compliance with all legal requirements concerning (but not limited to) corporation tax, corporation tax in relation to assets, income tax, national insurance, corporation tax on chargeable gains, VAT, customs and excise duties, landfill tax, stamp duty land tax, the construction industry scheme, insurance premium tax, environmental levies and all other direct and indirect taxes as appropriate, depending on the needs of the tax function and the business as cover for the rest of Group Tax.

• Gather information to support the claiming of land remediation relief, research and development tax credits, enhanced capital allowances and any other reliefs or credit claims as required by the Head of Tax.

• Maintain an up-to-date awareness of relevant tax legislation in respect of Group compliance with statutory requirements, International Accounting Standards and UK Generally Accepted Accounting Principles to the extent that they relate to direct and indirect taxation. Interpret and act on such legislation and standards as required by the Head of Tax.

• Identify and undertake effective tax planning in order to minimise the Group’s corporation tax, VAT, National Insurance Contributions, capital gains tax and PAYE liabilities, thus avoiding penalties, interest charges and prosecutions. Identify opportunities and drive process change or undertake effective tax planning in order to maximise tax losses, relief claims and tax credit claims and efficiency savings.

• Represent Group Tax internally and externally, including running and supporting training sessions, writing and maintaining internal guidance, negotiating where appropriate with HM Inspector of Taxes and external advisors to resolve complex issues and disputes and obtain favourable settlements.

• Undertake research into all tax issues which may have a tax consequence on Network Rail, its businesses and subsidiaries.
